By accessing or using the XRMarketing website or services, you agree to comply with and be bound by the following Terms & Conditions. If you do not agree, please do not use our services.
1. Services Offered
XRMarketing provides digital marketing and technology services including (but not limited to):
- Digital Marketing & Growth Strategy
- SEO, SEM (Google Ads)
- Social Media Marketing & Meta Ads
- Website & App Development
- UI/UX Design
- Marketing Automation
- WhatsApp & Email Marketing
- Content Creation & Branding
All services are delivered strictly as per the agreed scope, pricing, and timeline mentioned in the proposal/quotation.
2. Client Responsibilities
The Client agrees to:
- Provide accurate business details and required access
- Share content, approvals, and feedback on time
- Comply with platform policies (Google, Meta, etc.)
- Not misuse deliverables or strategies
⏱️ Any delay from the client side will automatically extend project timelines.
3. Payments & Billing (STRICT)
- 50% advance payment is mandatory before project initiation
- Remaining 50% must be paid before final delivery / handover
- For milestone-based projects, payments must follow agreed milestones
🚫 Non-Payment Clause:
If payment is delayed:
- Work will be paused immediately
- XRMarketing reserves the right to withhold deliverables, files, accounts, and access
If payment is not cleared within 7 days of due date:
- Project may be terminated
- No obligation to deliver pending work
💰 Late Fee Clause:
A reasonable late fee (e.g., 2%–5% per month) may be applied on overdue invoices.
4. Refund Policy
- Advance payment is non-refundable once work has started
- If XRMarketing fails to deliver the agreed scope: A partial or full refund may be issued based on work completed
- If delay or failure is caused by client: No refund applicable
5. Intellectual Property & Ownership
- All strategies, creatives, ad copies, designs, and frameworks remain the intellectual property of XRMarketing
- Ownership of final deliverables is transferred only after 100% payment is completed
Until full payment:
Client has no rights to use, publish, or claim ownership.
6. Project Suspension & Termination
XRMarketing reserves the right to suspend or terminate services if:
- Payments are not made as agreed
- Client provides false or misleading information
- Platform policies are violated
- There is misuse of services
7. Limitation of Liability
XRMarketing is not responsible for:
- Algorithm changes (Google, Meta, etc.)
- Ad account bans or restrictions
- Business losses or revenue fluctuations
- Third-party platform failures
Marketing results depend on multiple external factors.
8. Legal & Recovery Clause (India)
In case of intentional non-payment or fraud, XRMarketing reserves the right to initiate legal action under applicable Indian laws, including but not limited to:
- Indian Contract Act 1872
- Information Technology Act 2000
All disputes are subject to jurisdiction of Hyderabad, Telangana courts.
